Terms of Use

By creating an account, accessing the Service, or using any feature of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which is incorporated herein by reference.

WebSTAR reserves the right to change, modify, add, or remove portions of these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the Service following the posting of changes constitutes acceptance of the changes. If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity.

WebSTAR Content & Marks

Unless otherwise indicated, the Service is the proprietary property of WebSTAR Inc. All source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, user interfaces, and other content on the Service (collectively, the "WebSTAR Content"), and the trademarks, service marks, logos, and trade names contained therein (the "Marks"), are owned, controlled by, or licensed to WebSTAR and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

The WebSTAR Content and Marks are provided "AS IS" for your personal, non-commercial use only. No part of the Service may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written permission.

Proprietary Systems

The "16 Origins" quiz system, Origin classification framework, quiz question sets, scoring algorithms, and associated analytical methodologies are proprietary to WebSTAR. The WebSTAR AI advisor, including its personalization algorithms, prompt engineering, and response generation systems, are proprietary. You may not copy, reverse-engineer, decompile, extract, replicate, or create derivative works based on these systems.

Account Requirements

To access certain features, you must create an account with accurate, current, and complete information.

• Age requirement — you must be at least 16 years old. If you are under 18, you must have your parent or legal guardian's permission.
• One person, one account — each individual may maintain only one account. Automated account creation is prohibited.
• Security — you are entirely responsible for maintaining the confidentiality of your password and for all activity under your account. Notify WebSTAR immediately of any unauthorized use.
• Shared access — you may not share your credentials or use anyone else's account.

WebSTAR cannot be liable for any loss or damage arising from your failure to keep your credentials secure.

Content Ownership

You own your content. All portfolio items, project descriptions, images, videos, text, and other materials you upload ("User Content") remain your intellectual property. WebSTAR does not claim ownership.

License Grant

By posting User Content, you grant WebSTAR a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content solely in connection with operating the Service. This license terminates when you delete your content or account, except: (a) to the extent it was shared with others; (b) a reasonable time is needed for backup deletion.

Your Representations

• You own or have the necessary rights to submit your User Content and grant the license above.
• Your User Content does not infringe any third party's intellectual property, privacy, or other rights.
• Your User Content does not contain defamatory, obscene, illegal, or threatening material, or viruses or malware.

WebSTAR reserves the right to remove User Content that violates these Terms or applicable law. We will make reasonable efforts to notify you.

What You May Do

Subject to these Terms, WebSTAR grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Service. You may create a portfolio profile, take quizzes, use the AI advisor, share your profile link, and download or export your own data.

Prohibited Activities

You agree not to:

• Use robots, spiders, scrapers, or automated means to access the Service without written permission.
• Interfere with, disrupt, or create an undue burden on the Service.
• Attempt to bypass access restrictions or impersonate another user.
• Transmit spam, viruses, or other harmful material.
• Systematically retrieve data to create a competing collection or database.
• Decipher, decompile, disassemble, or reverse-engineer any part of the Service.
• Use AI advisor outputs to train competing AI models or services.
• Misrepresent AI-generated content as entirely human-created where such distinction is material.
• Harass, abuse, or harm another person through the Service.
• Sell, resell, or commercially exploit any aspect of the Service without authorization.

AI Advisor

The AI advisor provides suggestions based on your Origin results, portfolio, and interaction history. You acknowledge that:

• AI output does not constitute legal, financial, career, medical, psychological, or any other professional advice.
• AI-generated content may be inaccurate, incomplete, outdated, or inappropriate. You are solely responsible for evaluating all output before acting on it.
• References to third parties in AI output do not constitute endorsement by WebSTAR.
• You are solely responsible for decisions made based on AI recommendations.

Important: Notwithstanding any disclaimers, WebSTAR remains fully liable under Canadian law for all AI-generated information provided through the Service (see Moffatt v. Air Canada, 2024 BCCRT 149). WebSTAR uses third-party AI model providers. See our Privacy Policy for details.

Quiz System & Origin Classification

The "16 Origins" framework is a proprietary tool for professional self-discovery — not a psychological assessment, clinical diagnostic, or scientifically validated personality test. Origin classifications are for informational and developmental purposes only.

Prohibited Uses: The Origin quiz and results must not be used for employment recruitment, selection, hiring, promotion, task allocation, performance monitoring, termination, or any work-related contractual decisions. Such use is strictly prohibited and may violate the EU Artificial Intelligence Act (Regulation 2024/1689) for users in the European Economic Area. Employers or third parties using WebSTAR's quiz system for high-risk employment decisions do so in violation of these Terms and assume all legal liability.

You may retake quizzes at any time. WebSTAR does not guarantee any particular professional outcome from quiz results.

Free Tier

WebSTAR offers a free tier with core features, available indefinitely but subject to feature limitations.

Paid Subscriptions

Paid plans ("Plus," "Pro," "Business") provide access to additional features. By subscribing:

• You authorize WebSTAR to charge your payment method on a recurring basis (monthly or annually) at the then-current price.
• Subscriptions automatically renew unless you cancel before the renewal date. You will receive email notification at least 7 days before each renewal with the renewal date, amount, and cancellation instructions.
• You can cancel at any time from account settings or by contacting billing@webstar.com. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

Pricing Changes

WebSTAR may change prices with at least 30 days' prior notice via email and in-app notification. Price changes take effect at the start of your next billing period following the notice. If you disagree, you must cancel before the new price takes effect to avoid being charged the new rate.

Refunds

If you are within 14 days of your initial purchase or most recent renewal and have not substantially used paid features, you may request a refund at billing@webstar.com. Beyond 14 days, refunds are generally not available unless required by law.

Payment Processing

All payments are processed by Stripe. WebSTAR does not store your full credit card number. Payment is subject to Stripe's terms and privacy policy.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WEBSTAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WEBSTAR MAKES NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT, AI-GENERATED OUTPUT, OR LINKED THIRD-PARTY CONTENT.

Limitation of Liability

IN NO EVENT SHALL WEBSTAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM YOUR USE OF THE SERVICE, THIRD-PARTY CONDUCT, AI-GENERATED OUTPUT, OR QUIZ RESULTS. WEBSTAR'S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID WEBSTAR IN THE PRIOR 12 MONTHS, OR (B) US$100.00.

Some jurisdictions do not allow these exclusions or limitations, so they may not apply to you. In such cases, liability is limited to the greatest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless WebSTAR, its officers, directors, employees, agents, and suppliers from and against all losses, expenses, damages, costs, and attorneys' fees resulting from your violation of these Terms, your User Content, your use of the Service, or your violation of any third party's rights. WebSTAR may assume the exclusive defense and control of any such matter.

Third-Party Services

The Service may contain links to third-party websites and integrates third-party technologies (AI model providers, payment processors, authentication services). WebSTAR assumes no responsibility for third-party content, practices, or policies.

Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, submit a DMCA notification to legal@webstar.com including: (1) signature of the copyright owner; (2) identification of the copyrighted work; (3) identification and location of the infringing material; (4) your contact information; (5) a good faith belief statement; (6) a statement under penalty of perjury that the information is accurate. WebSTAR may terminate accounts of repeat infringers.

Termination by You

You may terminate your account at any time from Settings or by contacting us. Personal data will be permanently removed within 30 days, as described in our Privacy Policy.

Termination by WebSTAR

WebSTAR may terminate or suspend your access for cause, including breach of Terms, law enforcement requests, extended inactivity, fraudulent or illegal activities, technical or security issues, or discontinuance of the Service. We will make reasonable efforts to notify you. Upon termination, your right to use the Service immediately ceases. Sections that by nature should survive (IP rights, disclaimers, liability, indemnification, governing law) shall survive.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Disputes should first be directed to legal@webstar.com for informal resolution (30-day period), then mediation if necessary. Legal proceedings shall be brought in the courts of competent jurisdiction in Toronto, Ontario, Canada, and you consent to the jurisdiction and venue of such courts.

EEA Consumers: If you are a consumer based in the European Economic Area, the preceding venue provision does not apply. You may bring claims in the courts of the country where you reside. Nothing in these Terms affects your rights as a consumer under mandatory provisions of the law of your country of residence. You may also submit disputes to the European Commission's Online Dispute Resolution Platform.

UK Consumers: If you are a consumer based in the United Kingdom, you may bring claims in UK courts and nothing in these Terms affects your statutory rights under UK consumer protection law.

Australian Consumers: If you are a consumer based in Australia, nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, condition, right, or remedy implied or imposed by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted, or modified. You may bring claims in Australian courts.

Brazilian Consumers: If you are a consumer based in Brazil, nothing in these Terms affects your rights under the Brazilian Consumer Defense Code (CDC - Law No. 8,078/1990) or other mandatory consumer protection provisions. You may bring claims in Brazilian courts.

Other Jurisdictions: If you access the Service from a jurisdiction not explicitly mentioned in these Terms, you acknowledge that your use may be subject to local laws and regulations. You are responsible for ensuring your use complies with applicable local law. To the extent not inconsistent with mandatory provisions of your local law, these Terms shall be interpreted in accordance with Ontario law. Nothing in these Terms is intended to exclude or limit any rights you may have under mandatory consumer protection or data protection laws in your jurisdiction.

Statute of Limitations: Any claim arising under these Terms must be brought within two (2) years after the cause of action arises (or the minimum period required by your local law, whichever is longer), or such claim is permanently barred.

General Provisions

These Terms and the Privacy Policy constitute the entire agreement between you and WebSTAR. If any provision is held invalid, it shall be modified to the minimum extent necessary, and remaining provisions continue in full force. WebSTAR's failure to enforce a provision is not a waiver. You may not assign these Terms without WebSTAR's consent; WebSTAR may assign without restriction. WebSTAR shall not be liable for failures due to force majeure. Any feedback you provide is deemed non-confidential and may be used freely. By using the Service, you consent to electronic communications.
